The EA SPORTS NHL® 25 tournament presented by Game On: Scholastic Gaming Initiative is a new gaming tournament for EA SPORTS NHL® 25, challenging players to compete 1-on-1 for special prizes (the “Tournament”).

To sign-up for the tournament:

1. Create or log in to your free PlayVS Stadium account.

2. Navigate to the Competitions page and then the EA SPORTS NHL® 25 Tournament.

3. On the event you are interested in competing in, click Join this Event.

4. Click Create Team.

5. Enter your team information, then click Save.

6. Click Register Team.

7. To finalize your registration, click Confirm.

Discounts and prizing includes the following:

Champion (or Champion’s parent/legal guardian if a minor) will be required to complete an Affidavit of Eligibility and Liability & Publicity Release and a W9 tax form. Champion’s guest may also be required to complete a Liability and Publicity Release prior to participation in prize. You agree to resolve all disputes in connection with this Tournament and these Terms in individual arbitration (not in court). We believe the alternative dispute-resolution process of arbitration will resolve any dispute fairly and more quickly and efficiently than formal court litigation. We explain the process in detail below, but we’ve put this up front (and in caps) because it’s important:

We may update these Terms from time to time; you should check this page regularly to take notice of any changes. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

The Services, including all content, features, and functionality thereof, are owned by PlayVS, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

You are permitted to use the Services for your personal, non-commercial use only or legitimate business purposes related to your role as a current or prospective customer of PlayVS. Except as provided below, you must not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained through the Services, or delete, or alter any copyright, trademark, or other proprietary rights notices from copies of materials from the Services. However, if you are otherwise in compliance with these Terms, you

are permitted to use, elsewhere and on other websites, an unaltered copy of portions of the content that is publicly available on the Website for the limited, non-commercial purpose of discussing such content.

You may use the Services only for lawful purposes and in accordance with these Terms.

PlayVS has the right but not the obligation to monitor and edit or remove any account. PlayVS also has the right to terminate your access to all or part of the Services for any or no reason, including without limitation, any violation of these Terms. PlayVS may exercise these rights at any time, without notice or liability to you or any third party.

By participating in this Tournament, participants (and if participants are minors, their parent/legal guardians) agree to forever and irrevocably release and hold harmless PlayVS, the NHL Entities (as defined below), the NHLPA Entities (as defined below), Electronic Arts Inc., and each of their respective officers, directors, governors, members, partners, partnerships, principals, owners, employees, volunteers, representatives, agents, affiliates (past, present and future), related entities, successors and assigns (the “Released Parties”), from any and all liability for

any loss, harm, damage, injury, cost or expense of any nature whatsoever (including attorneys’ fees) (“Losses”) which may occur in connection with (a) this Tournament or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize, or any component thereof, or (c) participation in any Tournament-related activity or prize-related activity.

In addition, by participating in this Tournament, each participant (or if participant is a minor, their parent/legal guardian) agrees to indemnify and hold harmless the Released Parties from and against any and all damages, Losses, costs and expenses (including amounts paid in settlement and attorneys’ fees) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of participant hereunder, or (ii) participant’s participation in this Tournament or possession, use or misuse of

any prize or any component thereof.

To the full extent permissible by law, the Released Parties will not be liable for any loss of profits or any indirect, incidental, punitive, special or consequential damages arising out of or in connection with these Terms. These limitations and exclusions regarding damages apply even if any remedy fails to provide adequate compensation.

Any dispute or claim by you arising out of or related to these Terms shall be governed by California law, exclusive of its choice of law rules. For any disputes deemed not subject to binding individual arbitration, you agree to submit to the exclusive jurisdiction of the Superior Court of Los Angeles, California. You agree to waive any jurisdictional, venue, or inconvenient forum objections to such courts (without affecting either party’s rights to remove a case to federal court if permissible), as well as any right to a jury trial. This paragraph will be interpreted as broadly as applicable law.

Employees, officers, directors, agents and representatives of the National Hockey League (“NHL”), its member clubs, NHL Enterprises, L.P., NHL Enterprises Canada, L.P., NHL Enterprises B.V., NHL Interactive CyberEnterprises, LLC (the foregoing NHL entities collectively, the “NHL Entities”), the National Hockey League Players’ Association (“NHLPA”), its members (the foregoing NHLPA entities collectively, the “NHLPA Entities”), and each of their subsidiaries, affiliates, or parent companies are not eligible to participate in this Tournament.

This Tournament is in no way sponsored, endorsed, or administered by the NHL Entities or the NHLPA Entities. The NHL Entities and the NHLPA Entities are completely released from all liability by each participant in this Tournament.
